Conservation area ref 1972.014 Tree Reference: T1 Magnolia. Proposed Work: Fell, dismantle, and completely remove. Justification Reasons: Proximity: The trunk is growing directly against the external wall of the two-storey house. Light Nuisance: The 5 metre tall and 3 metre canopy spread covers windows and severely restricts natural light. Structural Risk: The root system is right up against the property foundations, creating an immediate concern for structural damage. 10/09/26 Amendment to address further information required. The tree is believed to be no older than 40 years old and therefore not subject to any constraints of the 1972 Tree preservation order. There is no evidence of any previous pruning that may have effected the size of the trunk or rate of growth and no previous applications for work to be carried out on the tree on the planning system.

T1 - Sycamore: The tree has a narrow fork with included bark between the main stems. Branches within the crown show bark stripping consistent with squirrel damage, leaving areas of exposed wood. Deadwood is also lodged within the crown. Felling is proposed due to concerns about the structural condition of the main fork and damaged branches, taking into account the tree's position beside the garden access steps and the potential consequences of falling material for people using this area. The tree is not visible from public viewpoints. T2 - Sycamore: The tree occupies a restricted rooting area adjacent to the wall. Its size and position raise concerns about its anchorage and the potential for whole-tree overturning. Failure of the root plate could displace the adjoining masonry and potentially cause the wall to collapse. Felling is proposed to address these concerns. The tree is not visible from public viewpoints. A Tree Preservation Order was made in 1973. The current dimensions of T1 and T2 suggest they became established after that date; these trees proposed for felling can be considered under a Section 211 conservation-area notification.

Consent was granted under application reference AT/2023/0123; however, the approved tree works were not undertaken. A new application is therefore being submitted. T1 ? Lime: Pollard to the specified height to manage the risk associated with extensive decay and hollowing within the lower stem. Mallet sounding indicates that the hollow extends approximately 750 mm above the uppermost visible cavity. T2 ? Western red cedar: Fell to ground level due to its poor physiological and structural condition following historically inappropriate and excessively severe pruning. The previous pruning does not accord with current good arboricultural practice as set out in BS 3998:2010 and has left the tree with limited potential for satisfactory long-term retention. The tree has limited visibility from public vantage points, and its removal would therefore have little effect on the area's wider visual amenity. T3 ? Oak: Reduce the crown to suitable growth points near the former pollard points, retaining adequate live growth wherever practicable. The work is required to reduce crown dimensions and associated mechanical loading because the tree occupies a confined position immediately adjacent to a boundary wall. The crown is markedly asymmetrical due to suppression and shading from taller neighbouring trees.

Minor lateral balancing cuts may be undertaken only where necessary to achieve a balanced and proportionate crown form. The works are being undertaken as part of informed, proportionate crown management in line with the survey recommendations to manage canopies that have been previously reduced. T1 Yew is highly tolerant of pruning, responds well to cyclical management, and retains good vitality and crown density after reduction. A modest 1.5?m crown reduction on a 5-year cycle is therefore proportionate, sustainable, and appropriate for the long-term management of this tree in its constrained position. The tree exhibits a pronounced downslope lean, damaging the garden steps and increasing the risk of progressive deformation and further structural impact on them. A light cyclical reduction will reduce end-weight, limit further displacement, and maintain the tree in a safe and suitable condition. T2 Pine selective reduction of the lowest-order branch by approximately 3?m to reduce end-weight and manage encroachment towards neighbouring houses and gardens. No alteration to the main crown structure. The tree displays a significant downslope lean, with the lower crown targeting neighbouring houses and gardens. The lowest-order branch carries disproportionate end-weight on the tension side of the lean, increasing the risk of progressive deformation and conflict with adjacent properties. A targeted 3?m reduction of this limb will reduce loading, limit further displacement, and maintain safe clearance. The proposed work is therefore proportionate, sustainable, and appropriate for the long-term management of the tree in its constrained position.

Lynway Court St Marychurch Road Torquay TQ1 3JP

T003 ? Mature lime: Pollard to the main crown break, retaining the main stem and permanent primary scaffold framework. Thereafter manage as a cyclical pollard, with re-pollarding anticipated approximately every seven years. The works are requested following a ground-based assessment and subsequent climbing inspection. The aerial inspection identified multiple cavities within load-bearing primary branches supporting substantial upright stems. Three cavities were reported to extend beyond the diameter of the affected branch when investigated using an eight-inch probe. Further cavities and significant historic pruning wounds with associated decay were also recorded. The affected crown is exposed to wind and overhangs St Marychurch Road, the unsheltered Hatfield Cross bus stop and parts of Lynway Court. The inspecting arborist considered ordinary crown reduction but concluded that it would not sufficiently address the defects distributed through the primary crown. Pollarding is therefore proposed as a tree-retention and risk-management measure, rather than removal. T004 ? Mature lime: Crown reduce from approximately 30 metres to 28 metres in height and reduce radial spread from approximately 9 metres to 7.5 metres. Retain a natural flowing canopy outline and prune to suitable growth points. The T004 works are limited to crown reduction; pollarding is not proposed for this tree. T004 has previously been crown reduced and has responded with approximately 1?1.5 metres of regrowth. The proposed reduction continues this established management approach while retaining the tree?s overall form and amenity contribution. Both trees will be retained. All works will be undertaken by a competent and appropriately insured arboricultural contractor in accordance with the approved specification and BS 3998:2010, subject to appropriate ecological and highway-safety controls.

Horse chestnut (T1) Proposed works: Crown lift of low branches to achieve a clearance of approximately 4m above ground level with cuts no larger than 50mm. Works are required to alleviate obstruction and encroachment onto the adjacent highway, driveway, garden, and property areas directly beneath the crown. Specification: All operations to be carried out in accordance with BS 3998:2010 (Tree Work ? Recommendations). Removal is limited to lower-order branches that impede access and damage the arrangement of first-order branches beneath the crown dripline. Works will maintain tree health and form, focusing on clearance rather than reduction. Supporting context: A similar consent was granted in 2015 due to the tree?s asymmetrical crown interfering with neighbouring vegetation. Current encroachment affects a well-established Japanese maple (SW) and Laurus hedge (E), both of which will benefit from reduced competition for light and space. Intervention will prevent further damage to the lower crown and improve coexistence with adjacent plantings. Reason for works: To ensure safe clearance above the highway and driveway, reduce interference with neighbouring vegetation, and maintain the long-term health and structural integrity of the tree.
